"These restrictions are totally unacceptable to us." - the ASF are looking for an alternative asking Sun to honour their contractual requirements for the Java SE test kit. One to watch.

Not looking for an alternative, just asking Sun to honour their contractual requirements to let Apache run the TCK against the Apache teams own codebase.
Without that TCK, without passing it, Apache can't use the word 'Java' in the product, or be granted the rights to whatever patents the JCP team have given to implementors of the specs.
It could be viewed as an apache/GPL split, but its more than that. Can sun retain total control of the Java codebase, or can Apache set it free?
